Bluegrass Fiber Monthly Speed Test Promotion 

Official Rules 

These Official Rules (“Rules”) govern the Bluegrass Fiber Monthly Speed Test Promotion (“Promotion”). By participating, entrants agree to be bound by these Rules and the decisions of the Sponsor, which are final and binding in all matters relating to the Promotion. 

 

1. Sponsor 

The Promotion is sponsored and administered by 
Bluegrass Fiber LLC 
(“Sponsor”). 

This Promotion is independently funded by Sponsor and is not sponsored, endorsed, administered by, or associated with any federal, state, or local governmental agency. 

 

2. Promotion Period 

The Promotion begins upon publication and continues on a month-to-month basis until terminated by Sponsor in its sole discretion. 

Sponsor reserves the right to modify, suspend, or terminate the Promotion at any time, for any reason, without prior notice, subject to applicable law. 

 

3. Eligibility 

The Promotion is open only to: 

• Active residential customers of Sponsor 

• Customers in good standing at the time of entry and at the time of prize fulfillment 

• Legal residents of the United States 

• Individuals who are 18 years of age or older at the time of entry 

Limit one (1) entry per active residential service account. 

Employees, officers, directors, contractors, agents, and representatives of Sponsor, and members of their immediate family (spouse, parent, child, sibling) or household, are not eligible. 

Void where prohibited or restricted by law. 

 

4. No Purchase or Review Required 

No purchase is necessary to enter or win. 

Entry is not conditioned upon: 

• Purchasing goods or services; 

• Providing a Google Review; 

• Providing a positive review. 

Submission of a Google Review is optional and does not increase or decrease the odds of winning. 

The Promotion is structured to comply with Kentucky law and does not constitute an illegal lottery because no consideration is required for entry. 

 

5. How to Enter 

To enter the Promotion: 

   1. From a desktop computer, laptop computer or the Speedtest.net mobile App, conduct a speed test          using Speedtest.net while connected to Sponsor’s residential internet service (the connection provided        by Bluegrass Fiber); the server must be listed as "Accelecom - Lexington, KY."

   2. Capture a screenshot/image clearly displaying: 

• Download speed 

• Upload speed 

• Server location 

• Date and time of test (include time/date stamp on desktop/laptop OR type time and date aquired in the submission of a mobile screenshot).

   3. Submit the screenshot via email to support@bluegrassfiber.com or via an authorized Sponsor                         communication channel. 

 

Entries must be received by 11:59 PM local time on the day before the monthly drawing to qualify for that month’s drawing. 

Incomplete, altered, fraudulent, automated, bulk, or illegible submissions may be disqualified in Sponsor’s sole discretion. 

Sponsor is not responsible for lost, late, misdirected, corrupted, or technically defective submissions. 

 

6. Drawing and Winner Selection 

One (1) winner will be selected by random drawing on the first Monday of each calendar month from all eligible entries received. 

Odds of winning depend on the number of eligible entries received. 

Winners will be notified using the contact information associated with their service account. 

If a selected winner does not respond within seven (7) calendar days of notification, Sponsor may select an alternate winner. 

Entries remain eligible for future drawings until: 

• The entrant is selected as a winner; 

• The associated account is closed or no longer in good standing; or 

• The Promotion is terminated. 

 

7. Prize 

Each monthly winner will receive: 

One (1) month credit toward the base monthly residential service plan. 

The prize: 

• Applies only to base monthly recurring residential service charges 

• Does not apply to taxes, equipment rental fees, installation charges, late fees, add-on services, or non-recurring charges 

• Must be redeemed within twelve (12) months of award 

• Is non-transferable 

• Has no cash value 

• May not be substituted except at Sponsor’s discretion 

Approximate retail value: up to the highest currently offered residential base monthly service rate. 

If the winner’s account is inactive at the time of redemption, the prize is forfeited.

To redeem the prize, a winner must contact us and request to apply the monthly service credit before their invoice for the preferred month is paid. 

 

8. Kentucky Compliance 

This Promotion is intended to qualify as a lawful promotional sweepstakes under Kentucky law and is conducted in accordance with applicable provisions of the Kentucky Consumer Protection Act (KRS Chapter 367) and other applicable laws. 

No payment, fee, or additional purchase is required to enter. 

The Promotion is designed to avoid the elements of an illegal lottery (prize, chance, and consideration) because no consideration is required for entry. 

 

9. Federal and State Tax Disclosure 

The approximate retail value of the prize does not typically exceed federal IRS reporting thresholds. 

If the total value of prizes awarded to an individual in a calendar year equals or exceeds applicable IRS reporting thresholds (currently $600), Sponsor may issue an IRS Form 1099-MISC as required by law. 

Winners are solely responsible for any federal, state, or local taxes associated with acceptance or use of the prize. 

 

10. Publicity and Use of Submissions 

By entering, participants grant Sponsor a non-exclusive, royalty-free license to use submitted speed test results for promotional purposes. 

Sponsor may publish anonymized speed results in marketing materials, social media, or a Customer Highlights section. 

Sponsor will not knowingly publish IP addresses, account numbers, or sensitive personal identifying information. 

Participants are advised not to publicly post speed test screenshots containing IP-related information. 

 

11. Limitation of Liability 

By participating, entrants agree to release and hold harmless Sponsor and its affiliates, officers, directors, employees, and agents from any claims, losses, damages, or liabilities arising out of participation in the Promotion or acceptance or use of any prize. 

Sponsor makes no warranties, express or implied, regarding the Promotion or the prize. 

Sponsor is not responsible for technical failures, internet disruptions, email delivery issues, or unauthorized intervention. 

 

12. Disqualification 

Sponsor reserves the right to disqualify any participant who: 

• Violates these Rules; 

• Engages in fraud, tampering, or abuse; 

• Uses automated entry methods; 

• Submits false or misleading information. 

Sponsor’s decisions are final in all matters relating to the Promotion.

13. Government Funding Clarification 

Sponsor participates in broadband deployment initiatives that may involve federal or state funding programs. 

This Promotion: 

• Is independently funded solely by Sponsor; 

• Does not utilize federal grant funds for prize fulfillment; 

• Does not affect eligibility for subsidized broadband programs; 

• Is not sponsored, endorsed, or administered by the National Telecommunications and Information Administration (NTIA), the Commonwealth of Kentucky, or any governmental entity. 

Participation in this Promotion does not influence service eligibility determinations under any grant program. 

 

14. Governing Law and Venue 

These Rules are governed by the laws of the Commonwealth of Kentucky without regard to conflict-of-law principles.

Participation in the Bluegrass Fiber Monthly Free Service Drawing is free and voluntary. By entering, participants agree that no monetary recovery or compensation of any kind is available and waive any claims for damages, including punitive, incidental, consequential, or indirect damages, to the fullest extent permitted by law.

 

15. Severability 

If any provision of these Rules is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
